BIFA would like to inform Members of the latest developments regarding the implementation of ICS2 Release 3 for road and rail modes, following a recent update from the European Commission and HMRC.
Despite calls for a delay until all Member States confirm their position on NCTS6 and the multiple filing functionality becomes available, the Commission confirmed that:
- A common EU-wide delay is not legally possible
- However, individual Member States may apply for a derogation from the 1 September 2025 implementation deadline. These applications must be submitted by 15 August 2025.
- The Commission will publish a list of Member States requesting derogations after 15 August. If granted, these derogations will apply retrospectively, allowing continued use of existing systems beyond the deadline.
- In countries not applying for a derogation, ICS2 filings for road and rail must begin from 1 September 2025.
- Multiple filing for road is not expected until Q4 2026
- Multiple filing for rail is expected in Q2 2026
In view of the above developments, HMRC has released an update to traders moving goods from Great Britain to Northern Ireland.
